One thing to note is this company PARKING EYE ... They have started monitoring Aldi, halfords etc. via video. They send you out a very convincing looking 'fine' for overstaying in the free car parks. They CANNOT ENFORCE ANY FINE ... The letter is basically an invoice they REQUEST you to pay, but make it look like a fine. ONLY THE COUNCIL CAN ENFORCE FINES FOR PARKING. You will get a letter stating you owe them £80 but can pay quickly at £50. You will then get two more automated letters threatening you first with court then the next with bailiffs. I concur with rivercop. The whole private parking thing is based on contract law - any 'ticket' they issue is not valid. They must issue an invoice before they can claim which can stand up in court. Even then, the costs, coupled with the fact that they will often lose if faced by someone who knows what they are doing, means that they rarely bother to go to court,

ONLY THE COUNCIL CAN ENFORCE FINES FOR PARKING. This has yet to be tested in court. Since they started to decriminalise parking, ie council's can fine you, they have opened up a big can of worms. Essentially, the Bill of Rights 1689 appears to state that only the court, or officers of the court (police) can levy a fine against a subject. This is where the problem lies. Neither the council nor their workers are considered as officers of the court so really their fines are null and void. Also, because of the way English Law works, you cannot make a new statute that contradicts a constitutional statute, and as Parking Fines no longer go via the courts, they go through some kind of committee, they can be defended. Mind, you can even get off parking tickets issued by the police if you know what to look for (Traffic Signs Regulations and General Directions 2002)
